BUDGET CAMERA RENTAL POLICY / TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the services provided by Budget Camera ("we," "us," "our"), a film equipment rental service in Toronto, Canada. By renting equipment, using our services, or accessing our website, you ("you" or "Customer") agree to be bound by these Terms. Please read them carefully before proceeding with any rental or using our services.

1. Agreement to Terms

By renting equipment or using any services provided by Budget Camera, you agree to these Terms. If you do not agree with these Terms, you must not use our services.

2. Rental Agreement

These Terms form part of the agreement between you and Budget Camera for the rental of film equipment. A separate Rental Agreement (which may be electronic or written) will be provided for each rental, outlining specific details of the rental transaction, including equipment, rental period, pricing, and additional terms. In case of any conflict between these Terms and the Rental Agreement, the Rental Agreement shall prevail.

3. Eligibility

To rent equipment, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction.
• Have a valid government-issued ID and provide accurate contact information.
• Provide a valid credit or debit card for payment and any required security deposit.

By renting from Budget Camera, you confirm that you meet these eligibility requirements.

4. Rental Period

The rental period begins on the start date specified in the Rental Agreement and ends on the return date specified. If the equipment is not returned on time, you may be charged additional fees at the daily rental rate until the equipment is returned.

• Late Fees: Failure to return the equipment by the agreed return date will result in additional charges at a rate specified in the Rental Agreement.
• Early Returns: No refunds will be given for early returns, store or rental credit will be applied for the remaining days.

5. Rental Rates and Payment

All rental rates are quoted on a daily, weekly, or monthly basis as specified in the Rental quote and order invoice. Prices are subject to change at our discretion. Payment is required to confirm a reservation or upon equipment pickup, unless otherwise agreed.

• Security Deposit: A security hold may be placed on your payment method at the time of rental to cover potential damage, loss, or late fees. This hold will be released upon the return of the equipment in the condition it was rented, provided there are no outstanding charges or damages. The amount of the hold will vary depending on the type of equipment rented.
• Payment Methods: We accept credit and debit card payments. Payment is processed through our secure payment system.

6. Delivery and Pickup

• Delivery: If you choose delivery, we will arrange for the transportation of the equipment to the location specified in the Rental Agreement. Delivery charges will apply as outlined at the time of rental.
• Pickup: You may choose to pick up the equipment at our store or delivery location. If you choose pickup, you agree to provide a valid ID and payment at the time of collection. If a team member is picking up on your behalf, you must communicate the team member's legal name to us via email prior to pickup. The team member must present a valid government-issued ID at the time of collection.

7. Use of Equipment

You agree to use the rented equipment only for its intended purposes and in accordance with all applicable laws. You are responsible for ensuring that the equipment is used safely and properly.

• Maintenance and Care: You agree to take proper care of the equipment and return it in the same condition as when it was rented. You are responsible for any damage or loss that occurs while the equipment is in your possession.
• Prohibited Use: You may not alter, modify, or tamper with the equipment. You may not sublease, rent, or lend the equipment to any third party.

8. Damage or Loss

You are responsible for any damage, loss, or theft of the equipment while in your possession. If the equipment is damaged or lost, you will be charged the cost of repairs or the full replacement value, as determined by Budget Camera. If any rental equipment experiences a malfunction, please promptly notify us. Failure to report any equipment issues, problems, damages, or shortages before returning the rented equipment may result in charges at the standard rate, including any applicable damage or replacement fees. It is our responsibility to ensure that the equipment you rent is complete and in proper working condition when it leaves our facility. 

• Insurance: We recommend that you purchase insurance for the equipment, either through us or a third-party provider. You may be liable for the full value of the equipment if it is lost, stolen, or damaged beyond repair, regardless of insurance coverage.

9. Cancellations and Modifications

• Rental credits are provided for all cancellations made no later than 24 hours before the scheduled pickup date. The rental credits can be used for future rentals.

• If you've already picked up your rental but wish to cancel or reschedule, rental credit will be applied to the remaining days of your rental. However, you will be charged for the days the equipment is with you, whether it's used or not

• In the case where a refund is necessary due to extenuating circumstances, a 15% processing fee will be applied for individual account and 20% for business account.
• If you wish to modify the rental dates or the equipment, you must contact us at least 24 hours prior to the rental start date. Modifications are subject to availability and may incur additional fees.

10. Indemnification

You agree to indemnify, defend, and hold harmless Budget Camera, its employees, affiliates, officers, and agents from any claims, damages, or losses arising out of your use of the rented equipment, including claims for personal injury, property damage, or any violation of these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, Budget Camera’s liability for any claim, loss, or damage arising out of or related to the rental of equipment is limited to the total rental fees paid by you for the specific equipment in question. Budget Camera will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits or business interruption.

12. Privacy and Data Protection

Your use of our services is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our services, you consent to the practices described in the Privacy Policy.

13. Termination of Service

Budget Camera reserves the right to terminate or suspend your access to our services or rental agreements at our sole discretion, including in cases where:

• You violate these Terms.
• You fail to return rented equipment on time.
• You provide false or misleading information during the rental process.

In the event of termination, you will still be liable for any outstanding charges or fees associated with the rental.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising out of these Terms will be resolved in the courts of Toronto, Ontario.

15. Miscellaneous

• Severability: If any provision of these Terms is found to be invalid, the remaining provisions will remain in effect.
• Entire Agreement: These Terms, together with the Rental Agreement, constitute the entire agreement between you and Budget Camera regarding the rental of equipment.

16. Disclaimer:

All rented products are provided "as is" and in the condition received from the manufacturer. We are not responsible or liable for any improper handling, operation, or use of the rented equipment. It is your responsibility to ensure that the equipment is used in accordance with the manufacturer's guidelines and recommendations.

We may change or modify these terms and conditions at any given time without notice. Call us if you have any questions.

17. No-Show Policy

In instances where reserved equipment is not collected, a charge equal to 50% of the one-day rental rate will be incurred, with a minimum charge of $10.00.
