This Equipment Rental Agreement (“Agreement”) is made effective upon completion of the rental form between the Renter (“Renter”) and Budget Camera Studio Inc. (“BC Studios”). By submitting this form, placing an order online, in person, or by phone, the Renter agrees to be legally bound by this Agreement and all associated Terms and Conditions, whether or not they have read them. BC Studios reserves the right to amend this Agreement at its sole discretion.
1. Intent
As a renter of BC Studios’ movable property, the Renter agrees to comply with all terms herein. The Renter assumes full responsibility for loss, damage, or misuse of the rented equipment (“Equipment”), including but not limited to loss or damage resulting from:
a) Corrosion, rust, rodents, insects, vermin, dampness of atmosphere, staining, or freezing.
b) Artificially generated electrical currents to electrical appliances or devices (including wiring).
c) Attempting to fix, update, adjust, or service the rented movable equipment deemed to be damaged.
d) Neglecting to use all reasonable means to save and preserve the rented movable equipment at and after any disaster, or when you have notice of an impending disaster.
e) A criminal or willful act or omission.
f) Any act committed or conspired to commit with the intent to cause loss or damage to the rented movable equipment.
g) Any actual or alleged spill, discharge, emission, dispersal, seepage, leakage, migration, release, or escape of pollutants.
h) Seizure or confiscation for breach of any law or by order of any public authority.
2. Disclaimer
Descriptions, prices, and availability are subject to change without notice. BC Studios reserves the right to correct any errors.
3. Lease
BC Studios leases to the Renter the Equipment listed on the invoice or cart generated at checkout (online or in-store).
4. Term
This Agreement commences on the rental start date and remains in effect until all Equipment is returned and inspected by BC Studios. The Renter must notify BC Studios of any changes to legal name, address, or contact information.
5. Late Return
Late return penalties apply as follows:
50% of daily rental rate after 2 hours past due
Full daily rental rate after 4 hours past due
Charges will be applied automatically to the payment method on file.
Non-Communication & Default Trigger
If any of the following occur:
BC Studios is unable to communicate with the Renter or their emergency contact(s) within 24 hours after a rental becomes overdue; or
BC Studios is unable to successfully charge overdue fees or penalties and no communication is received within 24 hours
The rental shall be considered IN DEFAULT.
a) Theft & Default Escalation
If the Equipment is not returned within 1 day of the due date, and no communication or response from the renter and their contacts, it may be reported as stolen.
BC Studios may immediately charge the full replacement value of the Equipment.
If payment cannot be collected, BC Studios will initiate civil and/or criminal recovery procedures, including engaging law enforcement and legal counsel at the renter's expense.
6. Use
Renter shall use the Equipment lawfully, carefully, and in compliance with all applicable laws and regulations.
7. Cancellation
Cancellation by Owner: BC Studios reserves the right to cancel any order, for any reason, at any time before delivery.
Cancellation by Customer: Rental credits are provided for all cancellations made no later than 24 hours before the scheduled pickup date. The rental credits can be used for future rentals. If you've already picked up your rental but wish to cancel or reschedule, rental credit will be applied to the remaining days of your rental. However, you will be charged for the days the equipment is with you, whether it's used or not
8. Ownership
The Equipment remains the sole property of BC Studios at all times. BC Studios claims no ownership over any content created using the Equipment.
9. Damaged or Modified Equipment
Renter shall keep the Equipment in good condition. Renter shall not materially modify or alter any part of the Equipment, including hardware or software
a) In the event of any form of modifications, Renter will be responsible for all reasonable costs in restoring the Equipment to its normal condition.
b) Renter assumes and shall bear the entire risk of damage to the Equipment from any cause, during the term of the Lease.
c) Unless pre-existing damage is reported to BC Studios at the time of pick-up, after Renter takes possession of the Equipment, it is assumed that any damage to the equipment occurred during the term of the Lease.
d) In the event of damage, the Renter is responsible either for replacing the item with a New Unit of the same product or paying the reasonable cost of repairs or replacement. If the item is not repairable, the Renter is liable to pay the full Replacement Value of the Equipment.
e) Renter's form of payment shall be charged the amount of repair expenses owed to BC Studios. If the Renter's form of payment cannot be successfully charged within 24 hours, the Renter shall be considered to be in Default.
f) At BC Studio's discretion, a cleaning fee may be charged if any of the following must be removed from the equipment upon return:
Smoke
Mud or dirt
Chalk or powder
Sand
Any other matter that must be removed from the Equipment before it is placed back in BC Studio's inventory
If repair or replacement charges cannot be successfully processed within 24 hours, the Renter shall be deemed in Default.
10. Loss of Equipment
Renter assumes and shall bear the entire risk of loss of the Equipment from any cause during the rental period.
a) Lost or Stolen Equipment - If the Equipment is reported by Renter to be lost or stolen during the term of the Lease, Renter is liable to BC Studios for the replacement value of the Equipment.
b) BC Studios reserves the right to charge Renters form of payment the amount owed for replacement of lost or stolen Equipment. or Renter's provided insurance can be used to offset the replacement cost of the missing item(s)
c) If the Renter's form of payment cannot be successfully charged within 24 hours, the Renter shall be considered to be in Default.
d) Unreturned Equipment - If the Equipment is not returned within seven days of expiration of the term of the Lease, the Renter shall be liable for the replacement value of the Equipment. c) In case of a dispute over whether the Renter returned the Equipment: If Renter used an alternate shipping method, not arranged in advance by the parties, and the Equipment is subsequently lost in transit, the Equipment is considered
ii. Owner shall charge the Renter's form of payment the amount owed for the replacement
of the unreturned Equipment. If the Renter's form of payment cannot be successfully charged within 24 hours, the Renter shall be considered to be in Default.
11. Insurance and Claims
The Renter acknowledges that rental insurance is provided to cover loss or damage to the rented equipment if the total replacement value of the rented equipment exceeds $15,000. In the event of loss or damage to the equipment, the Renter must immediately notify BC Studios (Budget Camera) and contact their insurance provider to initiate a claim within 24 hours of the loss incident. The Renter is responsible for any associated deductibles during the claim and replacement process.
12. Default
A Default occurs if the Renter:
Fails to return Equipment on time and is unreachable for 24 hours
Fails to pay overdue charges and is unreachable for 24 hours
Provides invalid contact or identification information
Refuses cooperation during recovery efforts
Upon Default:
All outstanding amounts become immediately due
BC Studios may:
Recover Equipment or its full value
Engage law enforcement
File civil claims
Employ debt collection agencies or investigators
13. Missing Accessories
In the event of any missing accessories (caps, hoods, tripod rings, bags, etc, Renter is fully liable to BC Studios for the replacement cost of the missing items.
14. Liability
BC Studios does not assume, and the customer indemnifies BC Studios against any liability or claims resulting from the use or malfunction of the equipment. The renter assumes all liability that may arise from the use or failure of the equipment.
If any rental equipment experiences a malfunction, please notify us promptly. Failure to report any issues, damages, or shortages before returning the equipment may result in charges at the standard rate, including applicable damage or replacement fees. Our responsibility is to ensure that the equipment is complete and in proper working condition when it leaves our facility. However, it is the Renters responsibility to use and handle the equipment correctly. BC Studios is not liable for improper use or insufficient knowledge of our rental equipment. Instruction manuals are available upon request.
15. Malfunctioning Equipment
In the case of malfunctioning Equipment, BC Studios only liability to Renter is for the portion of Rent applicable to the time period that the Equipment was non-functioning. BC Studios shall not be responsible for any consequential or incidental damages resulting from malfunctions.
16. Taxes or Duties
The Renter agrees to keep the Equipment free of any taxes, duties, liens, or other encumbrances. In the event such are levied against the Equipment, renter agrees to reimburse BC Studios in full for those charges.
17. Ownership
The Equipment remains at all times the sole and exclusive property of BC Studios. The Renter has no rights or claims to the Equipment. BC Studios does not have or make any claim to images, video, or sound recordings made by the Renter while using the Equipment.
18. Severability and Governing Laws
This represents the entire agreement between BC Studios and Renter. If any portion of this agreement is found unenforceable, it will not affect the remainder of the agreement, which shall remain valid and enforceable. The agreement shall be enforced according to the laws of the provinces of Ontario and Canada.
19. Security Deposit
We accept all major credit and debit cards (VISA, Mastercard, AMEX, Diners Club) for the security deposit. The amount of the security deposit varies depending on the replacement value of the entire rented equipment, ranging from $100 to $10,000.
To ensure coverage for all rental charges, the security deposit amount must be authorizable at the time of rental. This helps protect against any potential damages or losses.
Upon return of the equipment in its original condition, the security deposit will be refunded to your credit card within 24 hours or debit card within 1-5 business days. Any charges for damages or missing items will be deducted from the refund.
20. Acceptance of Agreement
Completing the form fields and uploading your government-issued identification constitutes full acceptance of this Agreement.
Use of space
Booking must be completed by adults only (18 years + If you are an adult and reserving the space for teen please ensure no alcohol is served or carried into the building.
The space must be returned to its original condition at the end of the session. This includes deep cleaning and garbage removal. If you require assistance with cleaning or disposing of production props or other waste, an additional fee will apply.
All forms of smoking. vaping and shisha are prohibited inside the property. Violating the smoking terms will result in immediate termination of the session with no refunds, and everyone must leave the building within 15 minutes; otherwise, local law enforcement will be contacted.
Dry ice. fog. and haze machines are allowed in the entire studio but must be monitored at all times.
Customers are responsible for any damages done by themselves or their guests during their session.
Capacity
The studio allows a maximum of 30 guests. Please stay within booked capacity; exceeding the booked number of guests inside the property will incur an added cost.
We reserve the right to end the session if the maximum capacity (30 guests) is exceeded.
Security deposit
A $750 security hold will be authorized on your credit card; this is not an actual charge. This will be deducted in the case of any required cleaning, repainting, damages, exceeded capacity and time or other studio violations. If the incurred cost is above the security hold, the difference will be charged to your authorized card on file. or a recurring payment arrangement will be scheduled.
Pets
A $350 refundable security hold is required for bringing pets into the studio. This covers damages and muck, otherwise will be cancelled after your session. Please be sure to contact the studio beforehand.

💳 Security Authorization
A small hold will be placed on your credit/debit card. The hold will be canceled upon the return of the rental.
We offer a convenient delivery service for all our rental gear within a 100km radius of our location. Our goal is to ensure you have everything you need on time and in perfect working condition.
Request: You can request delivery at any time during your reservation—in person, via email, or by phone.
Equipment Testing: All gear is thoroughly tested before delivery to ensure it’s fully functional and ready for use.
Inspection Upon Arrival: When the driver arrives, please inspect the equipment and verify the equipment list to ensure everything is in order.
Rental Requirements: To avoid cancellation, please ensure all rental processes and requirements are completed at least 2 hours before the scheduled delivery time. If not completed, the delivery will be canceled, and rental credit will be applied to your account.
Protection & Responsibility: We ensure all equipment is well-protected and safely transported. Once delivered, the client is responsible for any damage or issues that may arise while the equipment is in their possession.
